1.  Introduction

With this circular, Eurex Clearing informs its Members about amendments to the General Terms and Conditions to the Agreement on Technical Connection to the Clearing EDP of Eurex Clearing AG (hereafter: “GTC to the Connection Agreement”), as outlined in Attachment 1.

The Executive Board of Eurex Clearing AG decided with effect from 30 June 2025 to amend the GTC to the Connection Agreement.

Above-mentioned amendments are attached to this circular. As of the effective date, the full version of the amended GTC to the Connection Agreement will be available for download on the Eurex Clearing website www.eurex.com/ec-en/ under the following path:

2.  Required action

Third-Party Software must be registered. Third-Party Software that a Contractual Party obtains from an Independent Software Provider for connection to the Clearing EDP can only be registered if the Independent Software Provider has also registered with Eurex Clearing. Details about the registration of Third-Party Software and Independent Software Providers are outlined under section 3.

3.  Details

Third-Party Software must be registered. Third-Party Software that a Contractual Party obtains from an Independent Software Provider for connection to the Clearing EDP can only be registered if the Independent Software Provider has also registered with Eurex Clearing. Details about the registration of Third-Party Software and Independent Software Providers are outlined in section 3.

§ 9 Number 3 of the GTC to the Connection Agreement stipulates that Contractual Parties must register Third-Party Software (as defined in § 2 of the GTC to the Connection Agreement) prior to its connection to the Clearing EDP of Eurex Clearing. Third-Party Software that a Contractual Party obtains from a software provider (so-called Independent Software Provider ("ISV")) for connection to the Clearing EDP can only be registered if the ISV has also registered with Eurex Clearing. Prior to its connection to the Clearing EDP, Contractual Parties are obliged to notify Eurex Clearing which Third-Party Software will be used to connect to the Clearing EDP via the FIXML and FpML interfaces. Registration and notification must be carried out via an electronic platform provided by Eurex Clearing for this purpose (Member Section portal).

The Management Board of Eurex Clearing has set out more detailed provisions for the method of registration which can be retrieved from Attachment 2.

To ensure orderly Clearing EDP processes, § 9 Number 4 of the GTC to the Connection Agreement authorizes the Executive Board of Eurex Clearing AG, among other things, to prohibit the connection of Third-Party Software to the Clearing EDP and to interrupt an existing connection of Third-Party Software.

The amendments will come into effect on 30 June 2025 (“Effective Date”).

The amendments to the legal framework of Eurex Clearing AG published by this circular are deemed accepted by each affected contractual party of Eurex Clearing AG, unless the respective contractual party objects by written notice to Eurex Clearing AG prior to the relevant effective date(s) as stipulated in this circular. In case of an objection by the respective contractual party pursuant the preceding sentence, Eurex Clearing AG is entitled to terminate the respective contract (including a Clearing Agreement, if applicable). Instead of submitting an objection, the respective contractual party may submit in writing to Eurex Clearing AG comments to any amendments of the legal framework of Eurex Clearing AG within the first 10 Business Days after the publication of the amendments. Eurex Clearing AG shall assess whether these comments prevent the published amendments from becoming effective taking into account the interests of Eurex Clearing AG and all contractual parties.

Unless the context requires otherwise, terms used and not otherwise defined in this circular shall have the meaning ascribed to them in the Clearing Conditions or FCM Clearing Conditions of Eurex Clearing AG, as applicable.
